UN envoy blames Security Council divisions for lack of progress in ending Syria violence

Divisions in the Security Council are blocking progress toward ending the violence in Syria, and any eventual cease-fire will require the presence of an international peacekeeping force, the United Nations envoy for the country said Thursday.

Lakhdar Brahimi said he has the elements for a possible peace plan, but those elements "cannot be put together until the (Security) Council has come together and is ready to adopt a resolution that will be the basis for a political process."

World powers remain divided on how to stop Syria's crisis, with the U.S. and many Arab and European nations calling for President Bashar Assad to step down while Russia, China and Iran continue to back the regime. Russia and China have vetoed three Western-backed Security Council resolutions that would pressure Assad, including with the threat of sanctions, to halt the violence, and the U.N.'s most powerful body remains paralyzed.

"It bears repeating that the situation is bad in Syria and getting worse, that unfortunately the parties themselves are not ready to have an internal solution. The region is also not really capable, at this time, of helping for a peaceful solution. The place where a peaceful solution can be initiated is the Security Council," Brahimi told reporters after briefing the council behind closed doors.

Following the meeting, Syria's U.N. Ambassador Bashar Ja'afari blasted Security Council intransigence, blaming the U.S., France and Britain for failing to approve press statements condemning suicide bombings and other attacks carried out by opposition groups. He called it "a sign these countries are deeply involved in the terrorist attacks in Syria."

Brahimi said the elements of an eventual peace process would be based on a plan adopted in Geneva in June by key nations and international organizations that spelled out guidelines for a Syrian-led political transition. He said it would include a transitional governing body with full executive powers and an election, "with a lot of things happening in the middle."

But before that can happen, Brahimi said, the Assad regime and the rebels must stop their fighting.

"No doubt what is very, very urgently needed is a cease-fire that can hold," Brahimi said. "A cease-fire will not hold unless it is very strongly observed, and that, I believe, will require a peacekeeping mission."

A U.N. diplomat inside the council briefing, speaking on condition of anonymity because it was private, said Brahimi specified three "building blocks" ? a robust peacekeeping component on the ground which will require a Security Council mandate, a united opposition which many countries are working to establish and a transitional government with executive powers that would ultimately lead to elections.

Russia's U.N. Ambassador Vitaly Churkin said his country supported the Geneva agreement, which has the support of the five veto-wielding permanent members of the Security Council.

Churkin said Russia was forced to veto a Security Council resolution in support of it because his country "saw it as an attempt to rewrite the Geneva document, making it not an instrument for putting together a dialogue ... but an instrument of further confrontation and building up tensions in Syria." Russia objected to Western attempts to include any kind of pressure on Assad in the draft resolution.

Churkin added that while his country was trying to convince Syria to enter into serious dialogue with the opposition, Russia was very disturbed by political activity outside of Syria, particular the so-called "Doha coalition" ? which united many of Syria's disparate anti-government groups under a deal struck in the Qatari capital earlier this month.

"The Doha coalition is suspect in our view because of their political declaration which rules out any contacts with the government and which, in fact, talks about the need to topple the government," he said. "We're concerned about those who hasten to recognize the Doha coalition as the only legitimate representative of the Syrian people."

Churkin's comments came as officials said the Obama administration was preparing to recognize Syria's new opposition council as the legitimate representative of the Syrian people in the coming weeks. They spoke on condition of anonymity because they weren't authorized to speak publicly on the matter.

Announcement of the U.S. move ? which has already been taken by several European and Arab allies ? is planned on or around a conference of the Friends of Syria, comprising more than 70 nations, in Morocco on Dec. 12.

The new status is expected to be accompanied by pledges of additional humanitarian and nonlethal logistical support for the opposition, but it is unlikely to result in U.S. military assistance, at least in the short term.

According to activists, at least 40,000 people have been killed in the civil war since March 2011.

Polar Ice Loss Accelerating, Study Finds

Ice loss in Antarctica and Greenland has contributed nearly half an inch to the rise in sea levels in the past 20 years, according to an assessment? of ?polar ice sheet melting that researchers are calling the most reliable yet.

What's more, ice loss is rapidly speeding up in the north, while the rate in Antarctica has been fairly constant, the researchers report Friday (Nov. 29) in the journal Science.

Ice loss has been notoriously difficult to measure, and different studies have produced wildly different results, but the new study combines their methods to determine that the ice lost from Antarctica and Greenland accounts for .44 inches (11.1 millimeters), or a fifth, of the 2.2 inches that the seas have risen on average since 1992, said Ian Joughin, a glaciologist at the University of Washington in Seattle who collaborated on the study.

The rest of the sea level rise has been caused by melting of other ice around the world and by thermal expansion of ocean waters, which take up more space as they get warmer. Sea-level rise is not distributed evenly over the globe; some areas, such as off the U.S. Northeast, are disproportionately affected.

"Greenland is losing mass at about five times the rate today as it was in the early 1990s," study researcher Erik Ivins, an earth scientist at NASA's Jet Propulsion Laboratory, said in a press conference about the results. "In some contrast, Antarctica appears to be more or less constant, although for the last decade we appear to see about a 50 percent increase in ice-loss rate." Measuring melt

Climate and Earth scientists have long been concerned about the melting of the polar ice sheets, which has the potential to contribute to massive sea-level rise as the planet warms. Current projections range from somewhere between 8 inches (20 centimeters) and 6.6 feet (2 meters) of total sea-level rise over the course of this century.

But even figuring out how much ice is already gone is a difficult job. For one thing, ice loss and accumulation vary a lot from year to year, Joughin said. That means researchers have to look at multiple-year chunks of time.

Ivins says different studies of the ice sheets have had different strengths and weaknesses. "People were looking at different time spans, they were looking at data sets that had great fidelity in one region and not great fidelity in another region, or they were able to capture the physics of ice-sheet change for one aspect and very poorly for another," he said.

The result was a wide spread of ice-change estimates, ranging from a yearly loss of 676 metric gigatons of ice from Greenland and Antarctica combined, all the way to an actual accumulation of 69 metric gigatons each year. (A metric gigaton is a billion metric tons.)

Led by University of Leeds researcher Andrew Shepherd in the United Kingdom, the new effort is the first to combine these methods and compare them in an "apples to apples" way, Joughin said. Researchers on the project said their results were the most reliable yet in estimating sea ice losses.

Ice loss accelerating

The combination of previous observations revealed that no matter how you slice it, the poles are losing ice.

Between 1992 and 2011, Antarctica lost 1,320 metric gigatons (plus or minus 980) of ice, while Greenland lost 2,940 metric gigatons (plus or minus 940). Western Antarctica is losing significant amounts of ice, while eastern Antarctica is compensating somewhat by gaining some ice. That's consistent with patterns climate scientists have found that show climate change driving increased snowfall in eastern Antarctica, Shepherd told reporters.

Accelerating ice loss has also boosted ice sheets' contribution to sea-level rise over the last two decades, said Michiel van den Broeke, a study researcher from Utrecht University in the Netherlands. When averaged out over the past 20 years, ice-sheet melting has contributed about 20 percent of the overall sea-level rise, but when looking at the past few years, van den Broeke said, it has accounted for 30 percent to 40 percent of continuing sea-level rise. A study just released in the journal Environmental Research Letters finds that sea level is currently rising 0.12 inches (3.2 millimeters) annually, 60 percent faster than the estimate calculated by the Intergovernmental Panel on Climate Change in 2007.?

What researchers don't yet know is what the past ice-loss numbers say about the future. Greenland, especially, is seeing a major acceleration in ice loss, Joughin said. (This year, the summer Greenland ice melt broke a 30-year record, losing more ice than it ever has since record keeping began.) But you can't extrapolate the future from those trends, he said.

"It really remains unclear whether such losses will decline, whether it will level off or whether they will accelerate further," Joughin said. "To understand what is going to happen in the next century, we need models ? and right now those models are very much limited by lack of data."

A new study finds that female porn stars are more religious and have a higher self-esteem than other women.

The study, which was published in the Journal of Sex Research, concluded that these women do not fit the ?damaged goods hypothesis.?

?In terms of psychological characteristics, porn actresses had higher levels of self-esteem, positive feelings, social support, sexual satisfaction, and spirituality compared to the matched group,? the study titled ?Pornography Actresses: An Assessment of the Damaged Goods Hypothesis? concluded.

The study compared 177 porn actresses to a sample of women based on age, race and marital status.

According to the Toronto Sun, researchers shot down the ideas that women who work in porn came from broken families or hostile backgrounds.

The study also found that women working in porn tried more drugs, had their first sexual experience at a younger age and had more sexual partners than those in the sample group.

The study was conducted by Rresearchers from Texas Woman?s University, Shippensburg University and Adult Industry Medical Healthcare Foundation.

I can't agree with this point. I've found that sex is one of the important ways a man decides whether a woman is worth being with. Bad sex will equal a quick fade even after they've become exclusive.

Plus, people fall for people who are "into" them. Withholding sex for some arbitrary point is just a way of saying, "I'm not that into you."

As one of the five pillars of compatibility, I would encourage you to do whatever feels natural to you sexually, but remain aware that you are still learning about areas that you are or are not compatible on.

I disagree with the above bolded part. I didn't have sex with my husband prior to marriage, not because I wasn't into him, but because of a vow that I made not only to myself, but to my faith. It was hard, and we crossed some lines, but didn't have sex. Now of course this is not true for everyone, but I disagree that it says that you're not into them.

I do think that when sex is not on the table at the beginning you can filter through what a person is like, and if you are compatible in other areas.nsex can cloud emotions for some.

I have not read your articles yet but looking forward to reading them later.

Windows with Energy Efficiency in Mind

This is another installment in our series called Energy-Efficient Windows 101 made possible by Marvin Windows and Doors. In our first article of the series, I discussed some window basics and how to read a home window label. ?Now I want to discuss more product options available for your energy-efficient windows. ?When you buy Marvin windows, you?ll have the opportunity to decide how many panes you need and which glazing and gas options can contribute towards your home performance goals and well as maximize your comfort.

Dual- or Triple-Pane Windows

Marvin has window products with two or three panes of glass. ?Triple-pane, or tripane, windows are usually thicker, heavier, and have a lower U-factor and are attractive for northern climates.?That said, dual-pane windows are the most common and perform well. Your local dealer can help you select the right coatings for your climate; for example, some coatings are more ideal for the north while others for southern climate zones.

Insulating Glass Glazing Options

Marvin can cover glass panes with a thin layer of metallic material to improve the energy performance of the window. ?Specifically, low-emissivity, also LoE or Low-E, coatings on the glass surface and gaps between each pane can be used to block heat transfer through a window. ?The following coatings are available, depending on window and door needs:

Lo?-180? ? a single metallic coating blocks heat loss to the outside and reflects heat back inside a home. ?This coating is used when a high SGHC is needed, such as in northern climates.

Insulating Gases Between Panes

In addition, Marvin can inject gases between panes to improve window performance. ?Standard windows have argon to increase energy efficiency, while a blend of krypton, argon, and air is available in tripane products for enhanced performance in northern climates.

Wood/Aluminum Frame Options

Marvin offers wood interior or exterior, as well as durable extruded aluminum exterior option.

Additional Window Options

A couple of other options merit a quick mention as well. Marvin offers glass from Cardinal, whose designs prevent heat loss around the window perimeter. Former SNC-Lavalin executive charged in Switzerland: report

TORONTO (Reuters) - A former executive of SNC-Lavalin has been indicted in Switzerland on allegations he laundered money in connection with $139 million in payments by the company, according to CBC News and RTS, the Swiss public broadcaster.

Riadh Ben Aissa, a former vice president, has been charged with fraud, corruption and money laundering involving transactions executed in North Africa, according to the report.

The Royal Canadian Mounted Police are working with Swiss police on the investigation, according to the CBC, citing unidentified police sources.

Swiss authorities have tracked funds that flowed from SNC-Lavalin, Canada's largest engineering company, to Swiss bank accounts. The accounts were registered to companies in the British Virgin Islands, according to the report.

Ben Aissa was arrested in Switzerland last year on suspicion of money laundering and corruption of public officials but had not yet been formally charged.

SNC-Lavalin could not be immediately reached for a reaction to the report.

The company, however, told the CBC it was not commenting.

"Because these investigations are ongoing and we continue to cooperate, unfortunately there is nothing further that we are able to add at this time, except to reiterate that we hope that if anyone is found to have committed any wrongdoing, they are brought to justice," a company spokeswoman told the CBC.

Ben Aissa's Canadian lawyer was not immediately available for comment.

The Globe and Mail reported that the Tunisian-Canadian executive was in charge of SNC's international construction projects and a key link for the company to the former Libyan regime of Muammar Gaddafi.

SNC-Lavalin's former chief executive Pierre Duhaime resigned in March on accusations from the company that he authorized $56 million in payments to unknown agents on nonexistent construction projects. Canadian police are investigating.

They are also investigating bribery allegations against SNC executives involving a $1.2 billion bridge project in Bangladesh. The World Bank has suspended its loan for the development and temporarily banned an SNC subsidiary from bidding on its contracts in the country.

Flexible, low-voltage circuits made using nanocrystals

ScienceDaily (Nov. 26, 2012) ? Electronic circuits are typically integrated in rigid silicon wafers, but flexibility opens up a wide range of applications. In a world where electronics are becoming more pervasive, flexibility is a highly desirable trait, but finding materials with the right mix of performance and manufacturing cost remains a challenge.

Now a team of researchers from the University of Pennsylvania has shown that nanoscale particles, or nanocrystals, of the semiconductor cadmium selenide can be "printed" or "coated" on flexible plastics to form high-performance electronics.

The research was led by David Kim, a doctoral student in the Department of Materials Science and Engineering in Penn's School of Engineering and Applied Science; Yuming Lai, a doctoral student in the Engineering School's Department of Electrical and Systems Engineering; and professor Cherie Kagan, who has appointments in both departments as well as in the School of Arts and Sciences' Department of Chemistry. Benjamin Diroll, a doctoral student in chemistry, and Penn Integrates Knowledge Professor Christopher Murray of Materials Science and of Chemistry also collaborated on the research.

Their work was published in the journal Nature Communications.

"We have a performance benchmark in amorphous silicon, which is the material that runs the display in your laptop, among other devices," Kagan said. "Here, we show that these cadmium selenide nanocrystal devices can move electrons 22 times faster than in amorphous silicon."

Besides speed, another advantage cadmium selenide nanocrystals have over amorphous silicon is the temperature at which they are deposited. Whereas amorphous silicon uses a process that operates at several hundred degrees, cadmium selenide nanocrystals can be deposited at room temperature and annealed at mild temperatures, opening up the possibility of using more flexible plastic foundations.

Another innovation that allowed the researchers to use flexible plastic was their choice of ligands, the chemical chains that extend from the nanocrystals' surfaces and helps facilitate conductivity as they are packed together into a film.

"There have been a lot of electron transport studies on cadmium selenide, but until recently we haven't been able to get good performance out of them," Kim said. "The new aspect of our research was that we used ligands that we can translate very easily onto the flexible plastic; other ligands are so caustic that the plastic actually melts."

Because the nanocrystals are dispersed in an ink-like liquid, multiple types of deposition techniques can be used to make circuits. In their study, the researchers used spincoating, where centrifugal force pulls a thin layer of the solution over a surface, but the nanocrystals could be applied through dipping, spraying or ink-jet printing as well.

On a flexible plastic sheet a bottom layer of electrodes was patterned using a shadow mask -- essentially a stencil -- to mark off one level of the circuit. The researchers then used the stencil to define small regions of conducting gold to make the electrical connections to upper levels that would form the circuit. An insulating aluminum oxide layer was introduced and a 30-nanometer layer of nanocrystals was coated from solution. Finally, electrodes on the top level were deposited through shadow masks to ultimately form the circuits.

"The more complex circuits are like buildings with multiple floors," Kagan said. "The gold acts like staircases that the electrons can use to travel between those floors."

Using this process, the researchers built three kinds of circuits to test the nanocrystals performance for circuit applications: an inverter, an amplifier and a ring oscillator.

"An inverter is the fundamental building block for more complex circuits," Lai said. "We can also show amplifiers, which amplify the signal amplitude in analog circuits, and ring oscillators, where 'on' and 'off' signals are properly propagating over multiple stages in digital circuits."

"And all of these circuits operate with a couple of volts," Kagan said. "If you want electronics for portable devices that are going to work with batteries, they have to operate at low voltage or they won't be useful."

With the combination of flexibility, relatively simple fabrication processes and low power requirements, these cadmium selenide nanocrystal circuits could pave the way for new kinds of devices and pervasive sensors, which could have biomedical or security applications.

"This research also opens up the possibility of using other kinds of nanocrystals, as we've shown the materials aspect is not a limitation any more," Kim said.

The research was supported by the U.S. Department of Energy and the National Science Foundation.

"This is actually happening now," says Geraint Tarling of the British Antarctic Survey in Cambridge, UK. He and colleagues captured free-swimming sea snails called pteropods from the Southern Ocean in early 2008 and found under an electron microscope that the outer layers of their hard shells bore signs of unusual corrosion.

As well as warming the planet, the carbon dioxide we emit is changing the chemistry of the ocean. CO2 dissolves in water to form carbonic acid, making the water less alkaline. The pH is currently dropping at about 0.1 per century, faster than any time in the last 300 million years.

Lab experiments have shown that organisms with hard shells, such as corals and molluscs, will suffer as a result. To build their shells, corals and molluscs need to take up calcium carbonate from the water, but more carbonic acid means more hydrogen ions in the water. These react with carbonate ions, making them unavailable to form calcium carbonate.

Aragonite shortage

The most vulnerable animals are those, like pteropods, that build their shells entirely from aragonite, a form of calcium carbonate that is very sensitive to extra acidity. By 2050, there will be a severe shortage of aragonite in much of the ocean.

Aragonite is still relatively plentiful in most of the ocean, but Tarling suspected that some regions might already be affected by shortages.

He visited the Southern Ocean near South Georgia where deep water wells up to the surface. This water is naturally low in aragonite, meaning the surface waters it supplies are naturally somewhat low in the mineral ? although not so much so that it would normally be a problem. Add in the effect of ocean acidification, however, and Tarling found that the mineral was dangerously sparse at the surface.

"It's of concern that they can see it today," says Toby Tyrrell of the National Oceanography Centre in Southampton, UK.

Aragonite-depleted regions are still rare, but they will become widespread by 2050, says Tarling. The polar oceans will change fastest, with the tropics following a few decades after. "These pockets will start to get larger and larger until they meet," he says.

Tyrrell says the Arctic will become undersaturated with respect to aragonite before the Antarctic. Patches of undersaturation have already been seen, for instance off the north coast of Canada in 2008.

The only way to stop ocean acidification is to reduce our CO2 emissions, Tyrrell says. It has been suggested that we could add megatonnes of lime to the ocean to balance the extra acidity. However, Tyrrell says this is "probably not practical" because the amounts involved ? and thus the costs ? are enormous.

Mannequins spy on shoppers to boost sales

Shoppers beware: More and more mannequins are equipped with spy tech that?s helping retailers relieve you of your hard-earned money.

The EyeSee mannequins from Italian firm Almax SpA use facial recognition software to identify the age, gender, and race of shoppers who pass them by. The data allows retailers to tweak their marketing strategies, according to Bloomberg News.?

One retailer, for example, adjusted its window displays to catch the eyes of more men during the first two days of a sale after mannequin-derived data showed men spent more during those days than women.?

Another store decided to place Chinese-speaking staff near a particular entrance after 4 pm each day once it learned that more than a third of its visitors entering there were Asian.

The mannequin was unveiled in?2010?at a trade show. It is now being rolled out at high-end stores around the world such as Benetton Group, Bloomberg reports.

Similar facial-recognition?technology is standard fare in overhead cameras at casinos, but its move to eye level and hidden behind slender human-like forms and cash registers could help brick-and-mortar shops achieve a level of personalization commonly available to Web retailers via cookies and user profiles.

FCC to hold hearings on post-Sandy cell coverage

The Federal Communications Commission said Wednesday it will hold hearings at the start of 2013 to learn?whether the nation's wireless?networks could have, or should have, performed better in the wake of superstorm Sandy.

At the height of the devastating storm, about?25 percent of cell towers were knocked out in states affected by Sandy.?

Wireless carriers worked diligently to get service restored to mobile customers, but were hampered by water damage, physical damage to cell towers and power loss.?

Because of the massive damage caused by Sandy, it took more than a week for service to be up and running?close to 100 percent.

"This unprecedented storm has revealed new challenges that will?require a national dialogue around ideas and actions to ensure the resilience of communications,"??FCC chairman Julius Genachowski said Wednesday in a?statement.

Among the FCC's questions for the hearings, which will be held?first in New York:

  • "To what extent did service providers notify consumers of their communications options in?advance of the storm?"
  • "How can service providers best work together by sharing resources, such as cell sites, Wi-Fi?networks and transmission facilities?" (AT&T and T-Mobile?put into place an?agreement to?let customers in the region use roaming on each?other's network post-Sandy.)
  • "In what?ways can these arrangements be made in advance so that they are in place when disaster strikes?"
  • "When commercial power is unavailable, how long should back-up power sources be expected to?last?"
  • "What kinds of solutions are made available to customers?to help them charge devices like cellphones?" (Verizon Wireless, AT&T and T-Mobile all provided mobile charging stations as soon as they could get to hard-hit storm areas.)?
  • "What obstacles are there to connect to and receive emergency help and what technologies and?actions might help? Are there unique obstacles for the elderly or people with disabilities that?affect their use and access to communications regarding emergency services?"
  • "Why would services, once restored, perform at levels inferior to those customarily enjoyed by?users? How long can these performance degradations be expected to last?"

Representatives from AT&T and Sprint declined comment on the FCC action. NBC News also contacted Verizon Wireless and T-Mobile, and will update this post if we hear back.?

CTIA is?the trade group that represents wireless carriers. In a statement to NBC News, Chris?Guttman-McCabe, CTIA?vice president, regulatory affairs, said the group looks "forward to discussing the wireless industry?s proven commitment and dedication to providing critically important communications during times of natural disasters, particularly in light of a storm of such epic proportion as super storm Sandy."

The hearings also will focus on?communications by state and local officials and emergency personnel, the FCC said.

(AP) ? The Miami Marlins' latest payroll purge received final approval Monday from the commissioner's office, and as the team's top baseball executive began to discuss the deal during a conference call, a bad connection generated waves of reverberating noise that filled the phone line.

Nearly a week after the Marlins swung their widely ridiculed trade with Toronto, negative feedback keeps coming.

Commissioner Bud Selig approved the blockbuster deal, however, even though it made Marlins fans irate and made the team a nationwide punch line. The trade sends All-Star shortstop Jose Reyes to the Blue Jays along with pitchers Mark Buehrle and Josh Johnson, catcher John Buck and outfielder Emilio Bonifacio for seven players, none of whom has a big-money contract.

Miami received infielders Yunel Escobar and Adeiny Hechavarria, pitchers Henderson Alvarez, Anthony DeSclafani and Justin Nicolino, catcher Jeff Mathis and outfielder Jake Marisnick.

By swinging the deal only months after the Marlins moved into a new stadium built with taxpayer money, they pared from their books $146.5 million in payroll. That's their net savings after agreeing to send $8.5 million to the Blue Jays as part of the trade.

Marlins president of baseball operations Larry Beinfest said he understood why fans were mad, and confirmed the trade was necessary because owner Jeffrey Loria wanted to pare payroll. Beinfest also conceded the deal will make it harder for the team to recruit free agents in the future.

But Selig decided not to block it.

"This transaction, involving established major leaguers and highly regarded young players and prospects, represents the exercise of plausible baseball judgment on the part of both clubs (and) does not violate any express rule of Major League Baseball and does not otherwise warrant the exercise of any of my powers to prevent its completion," Selig said in a statement. "It is, of course, up to the clubs involved to make the case to their respective fans that this transaction makes sense and enhances the competitive position of each, now or in the future."

The players traded by the Marlins have combined guaranteed salaries of $163.75 million through 2018, including $96 million due Reyes.

"I understand the pause the fans have with the instability in our roster at a time when we were hoping to be very stable in the new stadium," Beinfest said. "It's not a lot of fun."

By contrast, the trade stamps the Blue Jays as contenders in the AL East. They haven't reached the playoffs since winning their second consecutive World Series in 1993.

Miami also finalized a deal with outfielder Juan Pierre, who agreed to a $1.6 million, one-year contract. That leaves the Marlins with an estimated opening-day payroll of $36 million for active players, which would be their lowest since 2008. In the latest figures, Oakland had the lowest payroll in the majors this year at $59.5 million.

While Beinfest said the Marlins acquired championship-caliber talent, fans believe owner Jeffrey Loria's goal was to increase his profits in the new ballpark rather than put increased revenue into the roster.

"We did receive a payroll range from ownership that we needed to achieve," Beinfest said. "With this transaction, we have achieved that payroll range."

The Marlins flopped as big spenders. They began the year with a franchise-record payroll of $112 million, then went 69-93, their worst record since 1999.

After sinking to last place by midseason, the Marlins traded former NL batting champion Hanley Ramirez, second baseman Omar Infante, right-hander Anibal Sanchez and closer Heath Bell. Reyes, Buehrle and Bell signed multiyear deals as newcomers a year ago during an unprecedented Marlins spending spree, and Beinfest acknowledged other free agents might be now reluctant to sign with Miami.

"It'll be a factor," he said. "I don't think we're happy about this at all. I understand there may be some disdain in the marketplace. We won't know until we get into those negotiations with free agents. It's definitely not great for the club, and we're going to have to deal with it."

Miami's biggest remaining star, slugger Giancarlo Stanton, has been among those expressing anger about the trade. Beinfest said he hadn't talked with Stanton about the deal.

"I know this is an emotional time," Beinfest said. "I'm sure it has been tough for him. Our feeling was to maybe let the dust settle a little bit and then talk to Giancarlo. I hear the frustration. It's not unexpected. This has been a tough go, but we think it's best for us moving forward."

Players' union head Michael Weiner withheld comment, saying he was awaiting more input from Major League Baseball.

In January 2009, the union reached an agreement with MLB and the Marlins covering 2010-12 which Weiner said was a "response to our concerns that revenue sharing proceeds have not been used as required. As part of the deal, Weiner said the team planned to "use such proceeds to increase player payroll annually as they move toward the opening of their new ballpark."

Selig said he was sensitive to how Marlins fans reacted to the trade.

"Baseball is a social institution with important social responsibilities, and I fully understand that the Miami community has done its part to put the Marlins into a position to succeed with beautiful new Marlins Park," Selig said. "Going forward, I will continue to monitor this situation with the expectation that the Marlins will take into account the sentiments of their fans, who deserve the best efforts and considered judgment of their club. I have received assurances from the ownership of the Marlins that they share these beliefs and are fully committed to build a long-term winning team that their fans can be proud of."

NOTES: Pierre would earn a $25,000 bonus if he's an All-Star, $25,000 each for winning a Gold Glove or Silver Slugger, $50,000 if he's an LCS MVP, $100,000 if he's the World Series MVP and $100,000 if he's the league MVP.

Giuliana and Bill: We'll 'evaluate' putting baby on TV

While Bill and Giuliana Rancic are comfortable living in front of reality show cameras, they're still deciding if they want their baby to do the same.

The centerpiece of Tuesday's season five premiere of ?Giuliana and Bill? is Edward's birth on Aug. 29.

?I think having a baby has changed our lives dramatically and we?re going to evaluate it,?? Bill said of whether the three-month-old will become a regular fixture on the show, which kicks off the season at 8 p.m. on the Style Network. ?We?re going to just see where we go from here. Whether he lives his life with the cameras on or not is yet to be determined, but we felt we owed it to all the people who have been on this journey with us to show them that hey, one in six couples struggle with infertility, and if you stick with it and never quit, it can pay off.??

The show has previously shown the couple?s struggles with infertility and Giuliana?s battle with breast cancer. As the couple started the process of in vitro fertilization, Giuliana learned that she had breast cancer, and underwent a double mastectomy.

Giuliana told Savannah Guthrie on TODAY Tuesday that she recently reached out to Miss America Pageant contestant Allyn Rose, who has announced that she is having a preventative double mastectomy because she lost her mother to breast cancer and is a carrier of the same rare chromosomal disease.

?We spoke on the phone the other day, and she?s lovely,?? Giuliana said. ?I said, ?Good for you. Good for you for getting out there, for getting in front of your health and for being an inspiration to young women.? She?s choosing her health over vanity.??

Giuliana, who is now cancer-free, will be on medication for the next 4 1/2 years. Baby Duke was born via surrogate.

?All my buddies were telling me what it was going to be like, but until you actually experience it, you have no idea,?? Bill said about fatherhood. ?It?s been absolutely magical for us.??

?It really is wild when I look back,?? Giuliana said. ?I just can?t believe it. That feels like so long ago that we held him in our arms, and it was just three months ago.??

Edward Duke was named after Bill?s late father Edward and Giuliana?s father, Eduardo. As for his middle name, the couple said they thought it was "cool."?

?It means ?leader,?" Bill said, "so we?re kind of going back and forth, and we?ll see what sticks.??

?I?m not going to lie; he does have a onesie that says, 'The Duke,''' Giuliana said. ?It?s right on his butt, and we love when he wears it.??

The couple just moved into a new house and haven't been getting much sleep as the baby gets used to his new surroundings.

?He was not happy, so he was up about every hour and that?s OK, that?s all part of this,?? Giuliana said.

?He eats like a horse,?? Bill said. ?He?s almost 17 pounds. He?s more than doubled his weight in three months.?
