The U.S. International Trade Commission will review a judge's decision which found that Apple did not violate patents owned by Samsung Electronics in making the iPod touch, iPhone and iPad.

An administrative law judge at the ITC had said in a preliminary ruling in September that Apple was innocent of violating the patents. The ITC, which could have opted to simply uphold the judge's decision, said that it would take up the matter. A final decision is expected in January.

If Apple is found to infringe, its devices can be banned for sale in the United States.

Apple and Samsung have taken their bruising patent disputes to some 10 countries as they vie for market share in the booming mobile industry.

Apple won a huge victory in August when a U.S. jury found the South Korean firm had copied key features of the iPhone. Apple was awarded $1.05 billion in damages. That ruling is under appeal.

In its announcement that it would review the case, the ITC asked for briefings on how it should consider standard essential patents, which are normally expected to be licensed widely and on fair, reasonable and non-discriminatory terms. The use of standards helps companies ensure devices are interoperable.

Some antitrust enforcers have argued that it is wrong for companies which own standard essential patents to ask for infringing devices to be barred from the country except in extreme instances.

The commission is reviewing a decision by ITC Judge James Gildea, who said in September that Apple did not violate the four patents at issue in the case, which was filed in mid-2011.

The two standard essential patents in the complaint are related to 3G wireless technology and the format of data packets for high-speed transmission.

Apple has a parallel complaint filed against Samsung at the ITC, accusing Samsung, a major Apple chip provider as well as a global rival, of blatantly copying its iPhones and iPads. An ITC judge said in that case that Samsung infringed on four Apple patents. The full ITC will issue a final decision in February.

Apple has waged an international patent war since 2010 as it seeks to limit growth of Google's Android system. The fight has embroiled Samsung, HTC and others who use Android.

Google's Android software, which Apple's late founder Steve Jobs denounced as a "stolen product," has become the world's No. 1 smartphone operating system.

Samsung is the world's largest smartphone maker, while Apple is in third place. Many experts consider Samsung's Galaxy touchscreen tablets the main rival to the iPad, although they are currently a distant second to Apple's devices.

Samsung is also a parts supplier to Apple, producing micro processors, flat screens and memory chips???both dynamic random access memory (DRAM) chips and NAND memory chips???for the iPhone, iPad and iPod. Apple has reduced orders from Samsung for chips and screens.

The case at the International Trade Commission is No. 337-794.

I used to program at personal goal setting for myself and achieved nothing but failure. The desire to fulfill these personal goals is always there. But, I am always unsure of where, when I should start. For instance, I wanted to keep my working area clean and tidy everyday but I always find it difficult to do so especially after a day?s work.

Goal Setting Tips
You have to be firm. Nobody is going to stand over your shoulder with a cattle prod, poking you to keep moving ahead. You are your own task master, you must stand what you believe beneficial to you. When you begin to procrastinate, remind yourself that you are responsible for making the most of your time and energy and power.
You have to be consistent. The only avenue anyone ever accomplishes what they set out after is through consistency and of being persistent.

'Glee' producer Ryan Murphy to honor Norman Lear

NEW YORK (AP) ? "Glee" co-creator Ryan Murphy didn't hesitate when given a chance to pay tribute to his American idol, legendary TV producer Norman Lear, at the 40th International Emmy Awards.

Lear's sitcom "All In the Family" ? and its spinoffs "Maude" and "The Jeffersons" ? mixed humor with an honest examination of the key social issues of the day ? racism, sexism, even abortion, rape and homosexuality. Decades later, Murphy is following the path blazed by Lear with his shows, "Glee" and "The New Normal."

Murphy and Lear are to receive honorary awards at Monday night's International Emmy Awards Gala. A total of 38 nominees from 15 countries will compete for awards in nine categories. British television productions received a leading seven nominations, including best actor and actress nods for Jason Isaacs, the villainous Lucius Malfoy in the Harry Potter films, in the crime mystery "Case Histories" and newcomer Joanna Vanderham in "The Runaway."

"I remember watching his shows when I was young and being moved by them," Murphy said of Lear from his production office in Los Angeles. "The way he tackled social issues so directly and opened a conversation about things no one wanted to talk about was fascinating to me.

"I try to do the same in my work, most recently with the 'Obama Mama' episode of 'The New Normal,' which was inspired by 'All in the Family.'"

In that Sept. 25 episode of his new NBC sitcom, about a gay male couple and the surrogate hired to carry their child, there's a heated discussion at a dinner party over whether to support Barack Obama or Mitt Romney reminiscent of Archie Bunker's debates with his liberal son-in-law Mike, whom he called "Meathead." Ellen Barkin's character Jane Forrest, the surrogate's ultraconservative grandmother, is prone to making racist and homophobic remarks much like the curmudgeonly working-class Bunker.

At Monday night's ceremony, hosted by Regis Philbin at the Hilton New York Hotel, Murphy will be presenting the 40th Anniversary Special Founders Award to Lear, now 90, and "MASH" star Alan Alda. The organizers wanted to mark the milestone anniversary by honoring a producer and performer who had groundbreaking shows on the air in 1972 when the International Emmys were first presented.

"Each of them is an iconic person in the history of the television business ... who were part of that incredible vanguard of a new kind of socially relevant, often in-your-face, television programs that really did change the medium," said Bruce L. Paisner, president and CEO of the International Academy of Television Arts & Sciences, which presents the International Emmys honoring excellence in television programming produced outside the U.S.

"'MASH' very cleverly used the Korean War as a stand in for social commentary on the Vietnam War. ... 'All in the Family' ? as well as everything that Norman did ? was a new approach to addressing social issues on television," said Paisner.

To complete the circle, Jessica Lange, the star of Murphy's gothic contemporary TV series "American Horror Story," will present him with the honorary 2012 International Emmy Founders Award.

"In terms of being at the cutting edge of changes in our society, Ryan Murphy may be the most significant producer in the industry today. He is trying very hard to change the way people think in ways that get people to be more inclusive and tolerant," said Paisner.

"Every once in a while a producer comes along who manages because he's a great storyteller to change the terms of the national discussion for the better. Norman Lear was certainly one and Ryan Murphy is another one," added Paisner, noting the recent election in which voters in three states approved same-sex marriage.

With "Glee," Paisner noted, Murphy also created a novel format mixing music with drama/comedy, which has had an influence abroad. Singapore's "The Kitchen Musical," a music-dance-drama about a young girl fresh out of a Parisian culinary school who goes to work in her father's famous restaurant, received two nominations.

Brazil had five nominations, all for TV Globo productions, while Argentina's four nominations included acting nods for Dario Grandinetti and Cristina Banegas in the miniseries "Television por la Inclusion."

Paisner said the International Emmys have come a long way since 1972 when about 100 people gathered in a New York hotel for a modest ceremony that handed out two International Emmys for fiction and non-fiction programming.

Now, the academy presents International Emmys in 20 categories with separate ceremonies for news and current affairs, digital productions and children's television. More than 1,000 television industry representatives from around the world are expected for Monday's gala.

Monday's ceremony will also honor Kim In-kyu, president and CEO of the Korean Broadcasting System, with the honorary 2012 International Emmy Directorate Award.

Former veterans pay respect to victims in Bosnia

SREBRENICA, Bosnia-Herzegovina (AP) ? Veterans from opposite sides of the brutal Balkan wars of the 1990s paid their respects Saturday to the victims of the worst massacre in Europe since World War II.

The small group of former fighters from Bosnia, Serbia and Croatia laid flowers at the memorial dedicated to over 8,000 Muslim Bosnian men and boys who were executed in 1995 by Serb forces in the eastern Bosnian town of Srebrenica.

The visit was organized by the Centre for Nonviolent Action, a non-governmental organization that promotes nonviolence and dialogue and encourages former foes to deal constructively with their past.

For most, this was the first time they had faced the magnitude of the crimes committed by their own forces. Participants said the visit left them "shocked" and "speechless."

Novica Kostic, a former soldier from Serbia said the group had visited other marked and unmarked places where people suffered during the wars "but this is heavy."

"This is horror. Genocide is a soft word for this. This is hell for my soul," the shaken veteran said.

After having watched a documentary about the massacre, the group walked along a wall with the names of the victims engraved. Many were overwhelmed by the thousands of graves that fill the valley near Srebrenica.

After the fall of the town in July 1995, residents fled to the nearby U.N. base seeking protection from Dutch forces. But when Serb forces led by genocide suspect Ratko Mladic ? now on trial before the U.N. war crimes tribunal in The Hague ? arrived at the base, the Dutch did not stop the Serb soldiers from separating men and boys out for execution.

The bodies of the victims are still being found in mass graves hidden in the area. The bones are identified through DNA analysis and returned to their families who bury them at this memorial center.

Ljuban Volas, a former Bosnian Serb soldier, said as a human being and as a soldier of the army that committed this crime, he simply "cannot approve it. Whoever did this must be held responsible."

The 1992-95 Bosnian war was the most brutal of the wars that erupted after Yugoslavia fell apart. The fighting between Bosnian Muslims, Serbs and Croats devastated Bosnia and killed over 100,000 people.

Midland, TX, United States (4E) ? Four military veterans died and 16 people were injured Thursday after a freight train slammed into a parade float filled with participants of a Texas event honoring U.S. troops.

According to a police spokesman, 37-year-old Gary Stouffer and 47-year-old Lawrence Boivin were declared dead at the scene while another two, 34-year-old Joshua Michael and 43-year-old Williams Lubbers died later at a nearby hospital.

Officials confirmed that the National Transportation Safety Board is investigating the incident that happened around 4:30 p.m. at a railroad crossing along Garfield Street and Industrial Avenue in Midland.

The first trailer in the ?Hunt for Heroes? event parade passed the crossing, but the second trailer, with 26 people, was hit by an eastbound train.

Police said some people in the truck were able to jump off safely.

Marcy Madrid, a hospital spokeswoman, said four people were admitted at Midland Memorial Hospital, one in critical condition and three were in stable condition.

Another person in serious condition was taken to a Lubbock hospital on Thursday night while 11 others have been released.

The group Show of Support said the event, which also include a banquet and an ?all expense paid whitetail deer hunt,? were created to honor members of all branches of the U.S. military.

Tom Lange, a spokesman for the Union Pacific Railroad, said the Union Pacific freight train, with more than 80 rail cars transporting double-stacked containers, was heading east toward Shreveport, Louisiana.

Initial investigation by the company revealed that the lights and gates at the crossing were functioning properly at the time of the crash and that the train crew had properly sounded the locomotive horn.

Lange added Union Pacific is investigating why the trailer was in the crossing and plans to review the video from a camera in the locomotive?s cab.

The train employee was not injured in the crash.

Investigators from the NTSB arrived on the site Thursday night and the rest of the team will follow on Friday, said Peter Knudson, a board spokesman.

NTSB has not confirmed whether the crossing gates and signals were working when the accident happened.
